Nicolai is a European Patent Attorney with extensive experience from industry and private practice. He has worked as Head of IP in a number of companies as well as a patent consultant in a leading Scandinavian private practice and in his own private consultancy. During his career he has gained thorough knowledge in the management of large patent portfolios, strategic IP management and all aspects of patent management. 

In particular, Nicolai specialises in strategic IP counselling and patent portfolio management. With his vast experience from day-to-day work as in-house patent counsel, he has a special insight in all practical considerations and demands from various stakeholders in an organisation. Combined with the highest standard in his field, he offers a pragmatic counselling with special focus on value creation and commercial usability.

Apart from strategic counselling, Nicolai has extensive expertise in patent drafting, patent prosecution, freedom-to-operate, patent infringement and invalidity. He has excellent records in opposition and appeal proceedings at the European Patent Office and has been involved in litigation proceedings in various jurisdictions. He has also gained special knowledge about administrative procedures in the US.

As a special interest, Nicolai is active in the Litigation Committee at the European Patent Institute (epi) where he has worked with improving the legal framework of the Unified Patent Court. He has also been elected as the Danish Council Member at the epi. In addition, he has been appointed as Expert Judge at the High Court of Western Denmark and has qualified as representative before the Unified Patent Court. He is also an active member of the Examination Committee at the European Patent Office.

Career history

After obtaining an MSc Microbiology at University of Aarhus, Nicolai joined a leading Scandinavian private practice where he worked as a patent attorney with all aspect of patent counselling. He worked with various technologies in the Life Science field, including medical sciences, food sciences, biotechnology, chemistry, pharmaceutical sciences and medical devices.

Dedication to in-house IP activities and patent strategy management started his industry career. Here he worked as Head of IP in a number of companies within the field of pharmaceutical sciences, medical devices, chemistry and food sciences. During his work, Nicolai has obtained practical knowledge of all aspects of in-house patent activities, including IP management, budget responsibility, patent drafting and prosecution, freedom to operate analysis and IP strategy.
